Uma identidade local para o Direito

Os caminhos da sociedade seguem os mais diferentes
rumos. As mudanças são constantes, transformadoras, algumas
leves outras profundas e vão construindo e desconstruindo as
identidades. É difícil perceber valores que identificam uma
nacionalidade; o que temos são pequenas identidades que
formam redes interligadas originando um espírito nacional e até
internacional. Quando se fala em direito, pensa-se em sistema
jurídico legal, no dizer kelseniano, e isso cria uniformização,
na qual todos os fatos jurídicos são formatados nos limites dos
diplomas legais em honra de uma suposta segurança jurídica.
Mas a sociedade deve ser vista, no dizer de Deleuze e Guattari,
como um rizoma onde o local se entrelaça e se junta a outros
locais formando o geral e ai está o ponto fundamental a ser
percebido pelo Direito. O pós-positivismo, que se estrutura
depois da segunda grande, guerra reivindica essa reflexão em
que os fatos são vistos neles mesmos dentro de sua representação
local com valores com suas formas específicas e ai está o
caminho do que se chama justiça

The paths of society are constantly shifting. Change is
constant and transformative. Some changes are light, while others
are more profound, constructing and deconstructing identities.
It is difficult to perceive values that identify a nationality; what
we have are small identities that form interconnected networks
yielding a national and even international spirit. When referring
to law, one usually thinks of the kelsenian legal-judicial system,
and this creates uniformity, in which all legal facts are formatted
within the limits of legal instruments in deference to a presumed
legal certainty. Yet, according to Deleuze and Guattari, society
should be seen as a rhizome in which each location intertwines
with and joins other locations, thus forming the whole, and that
is the key point to be noticed by Law. Post-positivism, which
took root after World War II, supports this reflection, in which
the facts are viewed per se, within their local representation of
values with their specific forms, and this is the path of what is
called justice.
