Quando Estados se unem em torno de valores e princípios compartilhados, formam uma sociedade internacional. Dentro dessa sociedade internacional, existe uma disposição de poder disciplinada por uma Constituição. O presente artigo pretende questionar em que medida a União Europeia incorpora uma Constituição de determinada sociedade internacional — dos Estados europeus. Para tanto, irá primeiramente discutir o que se entende por Constituição, com particular atenção ao plano internacional, apreciando elementos jurídicos e não-jurídicos. Em seguida, analisará o atual desenho institucional da União Europeia, além de alguns casos concretos decisivos para entender a relação jurídica do Direito Europeu com os Estados membros da União Europeia. Finalmente, cumpre comparar a ideia exposta de Constituição de sociedade internacional com o que o núcleo do Direito Europeu efetivamente representa, a fim de abordar o questionamento inicial.
When States unite around shared values and principles, they form an international society. Inside such international society, there is a power arrangement regulated by a Constitution. The present article intends to question to which extent the European Union contains a Constitution of a specific international society — the European States one. To achieve this, it will first discuss what is understood by Constitution, with particular attention to the international field, considering both the juridical and non-juridical dimensions. Secondly, it will analyze the current institutional arrangement of the European Union, as well as some decisive case law to understand its juridical relation regarding its member-States. Lastly, what is left is to compare the described idea of Constitution of international society with what the European Union effectively represents, as to tackle the initial questioning.
