Escrito para o simpósio que marcou o 65º aniversário de Winfried Hassemer, o artigo demonstra que o seu pensamento continua atual e relevante. A partir de importantes contribuições da teoria penal de Hassemer, um dos maiores representantes da Escola jurídico-penal de Frankfurt, discute-se a teoria pessoal do bem jurídico e qual o papel desempenhado pelo direito penal em relação às chamadas “vítimas de amanhã”, analisando-se, portanto, a legitimidade de um modelo penal que busca, por meio da orientação para a vítima, garantir as condições de existência das gerações futuras.

"Written for the symposium marking the 65th anniversary of Winfried Hassemer, the article demonstrates that his thinking is still current and relevant. From important contributions of the criminal theory developed by Hassemer, one of the greatest members of the “Frankfurt School”, it discusses the personal theory of protected legal interest and the role played by criminal law in relation to so-called “victims of tomorrow”, analyzing therefore the legitimacy of a penal model that seeks, through the guidance for the victim, ensure the living conditions of future generations."
