Este artigo analisa as alterações promovidas pela Lei n.o 14.442/2022 no tocante à regulamentação do teletrabalho, buscando avaliar se a referida legislação se adequa aos parâmetros constitucionais de proteção ao trabalho. A partir da identificação das mudanças ocorridas nessa modalidade de trabalho à distância, busca-se compreender os efeitos da invisibilidade digital, sobretudo no que concerne aos riscos de não efetivação do direito fundamental à limitação da jornada de trabalho.
This article analyzes the changes promoted by Law n.º 14.442/2022 re-garding the regulation of telework, seeking to evaluate whether this legislation fits the constitutional parameters of protection to work. From the identification of the changes that occurred in this modality of distance work, we seek to understand the effects of digital invisibility, especially regarding the risks of not realizing the fun-damental right to limit the working hours.
