O presente artigo trabalha o pensamento da filósofa Simone de Beauvoir, o feminismo existencialista projetado em sua obra O segundo sexo, e algumas contribuições de suas reflexões para a filosofia do direito. Com o método hipotético-dedutivo, analisar-se-á o processo de desenvolvimento do feminismo a partir do existencialismo, importante para a filosofia de Beauvoir e seu papel na construção do conhecimento filosófico para o campo das conquistas dos direitos das mulheres. Além de que em sua obra, ela interpreta, compreende e critica socialmente a situação da mulher como realmente era, a dominação machista e patriarcal na história da humanidade. Este ensaio teórico apresenta a seguinte problemática: quais as contribuições de Simone de Beauvoir e do seu feminismo existencialista para a filosofia do direito? Para responder esse questionamento, será apresentada a filosofia de Beauvoir na defesa da libertação das mulheres no sistema patriarcal, da autoafirmação, da desnaturalização das desigualdades de gênero e questionamento do que é ser mulher. Para alcançar esse objetivo, será compreendido a crítica ao eterno feminino e o caráter fundamentalmente político e filosófico do feminismo existencialista que pode refletir as esferas jurídicas.
This article deals with the thinking of the philosopher Simone de Beauvoir, the existentialist feminism projected in her work The second sex, and some contributions of her reflections to the philosophy of law. With the hypothetical-deductive method, the development process of feminism from existentialism will be analyzed, important for Beauvoir’s philosophy and its role in the construction of philosophical knowledge for the field of women’s rights achievements. In addition to that in her work, she interprets, understands and socially criticizes the situation of women as it really was, the sexist and patriarchal domination in the history of humanity. This theoretical essay presents the following problem: What are the contributions of Simone de Beauvoir and her existentialist feminism to the philosophy of law? To answer this question, Beauvoir’s philosophy will be presented in defense of women’s liberation in the patriarchal system, self-affirmation, the denaturalization of gender inequalities and questioning what it is to be a woman. To achieve this objective, the critique of the eternal feminine and the fundamentally political and philosophical character of existentialist feminism that can reflect the legal spheres will be understood.
