Marriage is a sacrament. It is a relationship between two people involving love and sexual intimacy. A woman in a marital relationship has rights but these rights have been extinguished under the shield for abuse. Many women in marital relationship are subjected to violence. ‘Sexual violence’ severely impacts the wives and may cause irreparable damage in their lives. States failure to criminalize the crime prevents a scene of giving permission for the crime. Preventing Sexual violence is an obligation of the state and important ambit of human rights law to ensure gender quality. The Law has made successful changes in ensuring women getting gender justice. The time has come to criminalize marital rape in India. Failure to criminalize sexual offences especially marital rape denies women of their human rights.2 The Article dwells on ‘sexual offences.’ The Article argues that criminalizing marital may be the first step but societal attitude and change in mannerisms are important in eradicating the crime. The Article makes suggestions in eradicating sexual offences and suggests the model of restorative justice.
