Este trabalho pretende assinalar o comum denominador que subjaz a textos, de diferentenatureza e datação, concernentes a posição assumida por Kant acerca da necessidade de fundamentação a priorida filosofia da história e, notadamente, do direito e da política, necessidade,esta, que ultrapassa a dimensão teórica, refletindo-sediretamente na configuração da organização civil.Demodo particular, tentar-se-áaqui mostrar comotalquestão interage estreitamente com a do direito de resistência, o qual se torna uma chave de leitura útil para salientar as articulaçõesda proposta kantiana nessesespecíficosâmbitos da investigação prática. A partir do exame dodebate sobre odireito de resistência, revitalizado pelos acontecimentos revolucionários da época, a perspectiva de análise kantiana revela toda sua coerência, ao tornar-se inseparável de um juízo político firme e esclarecido sobre os eventos contemporâneos a Kant. De um lado, se justifica a contraposição de Kantàmuda observância das relações jurídico-políticas existentes, que garanteum tranquilo bem estar, mas, ao pedir, em troca,o silêncio da razão, impossibilitaqualquerprogresso que não passe de uma simples perpetuação passiva de um povo, ao longo do tempo; de outro lado, ao mesmo tempo,se explicamas razões pelas quais Kantnão pode ceder às tentações de um fácil entusiasmo. Abrir mão dessa equilibrada postura crítica constitui o erro teórico que se concretiza em erros políticos. Nesse intuito, a partir da análisedas observações dedicadas àRevolução Francesa–presentes nopensamentokantianodesde 1789, ecuja função se mantém inalterada ao longo da década toda de 90–serão percorridas algumas etapascentraisda reflexão jurídico-política de Kant, indicando a especificidade de cada uma e, ao mesmo tempo, sua fundamental coerência.

The aim of this paper is to underline the common denominator of texts of different nature and dating, concerning Kant’s position about the need to found a priorithe philosophy of history and, especially, the philosophy of law and politics. This need exceeds theoretical dimension and is reflected directly in the configuration of civil organization. In particular, this paper tries to show how this issue closely interacts with the right to resistance, which becomes an useful reading key to highlight the articulations of Kantian point of view within this specific area of practical philosophy. Through the examination of the debate about the right to resistance, revitalized by revolutionary events of that age, the perspective of Kantian analysis reveals all its coherence, because of its inseparability from a political judgment on the events contemporary to Kant, political judgment which is firm and enlightened at the same time. So, on the one hand, Kant’s opposition to the silent observance to the existing legal and political relations, which guarantees a peaceful well-being, is justified, but this observance, asking in return the silence of reason, stops any progress that goes beyond a simple passive perpetuation of a people during time; on the other hand, the reasons why Kant cannot yield to temptations of an easy enthusiasm are meanwhile explained. Giving up this balanced critical position is the theoretical mistake that causes political mistakes. For this purpose, on the basis of the analysis of the observationsabout French Revolution –present in Kantian thoughtsince 1789 and whose function remains unchanged all through the 90s –this paper will cover some central steps of Kant's legal and political reflection, indicating the specificity of each of them and, at the same time, their fundamental coherence.
