Resumo Português:

O presente trabalho procura sustentar a constitucionalidade da responsabilização criminal
da pessoa jurídica em face dos bens ambientais. A abordagem criminal considerou a pessoa jurídica
como ente real (teoria da realidade), provido de uma vontade (culpabilidade) social, que se exterioriza
através da soma de vontades das pessoas individuais que a integram ou administram. Essa vontade
social lhe confere capacidade para a prática de delitos, que lhe serão imputados através de uma
responsabilidade de natureza objetiva, decorrente da aplicação da teoria do risco integral da atividade
econômica, prevista e adotada pela Constituição Federal, quando tratou da ordem econômica. O estudo
é encerrado, analisando-se as penas cabíveis de serem aplicadas ao ente coletivo e que possam servir
como meio eficaz de prevenção, capaz de inibir novas incursões danosas ao bem ambiental.

Resumo Inglês:

This work seeks to sustain the constitutionality of the criminal liability of legal entities in
the face of environmental goods. The approach considered criminal to a legal entity as real (theory of
reality), equipped with a will (guilty) social, which is shown as the sum of individual wills of the
people that operate or manage. This social will give it the capacity to commit irregularities, which will
be charged with a responsibility of objective nature, arising from the application of the theory of the
full risk of economic activity, planned and adopted by the Federal Constitution when it considered the
economic order. The study is concluded by analyzing the criminal sanctions to be imposed collective
entity and which may serve as an effective means of prevention, can inhibit further incursions and
harmful to the environment.
