O presente trabalho examinará o papel do Banco Mundial como sujeito de direito internacional com relação às suas possíveis obrigações para com os direitos humanos. Primeiramente, será analisada a relação fundamental entre direito ao desenvolvimento e os demais direitos humanos, defendendo-se a tese da sua indivisibilidade, além da intrínseca relação entre a atuação do Banco com o direito internacional dos direitos humanos. Em segundo ponto, será investigada a atuação do Banco Mundial e sua resistência histórica quanto a implementação e reconhecimento da importância dos direitos humanos para as suas políticas. Em terceiro ponto, será examinado se, de fato, pode-se considerar que o banco tem obrigações inerentes de direito internacional. Por fim, serão elencados obstáculos para que essa implementação dos direitos humanos em políticas da instituição se concretize, bem como possíveis soluções para superá-los.
Resumo Inglês:
This paper will focus on the role of the World Bank as a subject of international law regarding its possible obligations under human rights law. Firstly, it will be analyzed the fundamental relationship between the right to development and the other human rights, in order to support the thesis of their indivisibility, along with the analyzes of the intrinsic connection between the bank’s role and the international human rights law protection. Secondly, the bank’s performance and historical resistance will be investigated concerning the implementation and recognition of the importance of human rights for their policies. Thirdly, it will examine whether it can be considered that the Bank carries inherent obligations under international law. Finally, obstacles to the implementation of human rights within the institution's policies will be identified, as well as possible solutions to overcome them.
