Os desenvolvimentos científicos em cirurgia robótica e telecirurgia têm revolucionado a prestação dos cuidados à saúde. Contudo, os avanços tecnológicos não eliminam o fator de imprevisibilidade no tratamento médico, pelo contrário, algumas vezes, os progressos da medicina podem tornar ainda mais aleatórios o diagnóstico e a terapia. No contexto das cirurgias assistidas por robôs, seja de forma presencial ou à distância, o consentimento informado do paciente adquire certas peculiaridades, tendo em vista os diversos fatores aleatórios e riscos inerentes à própria tecnologia. Assim, o presente trabalho propõe-se a analisar o contexto brasileiro, europeu e norte-americano, dos riscos e benefícios associados às referidas tecnologias e o conteúdo necessário de informações repassadas aos pacientes, bem como as formas de responsabilização e a quantificação de danos pela violação do dever de informação.

Scientific developments in robotic surgery and tele-surgery have revolutionized healthcare provision. However, technological advances do not eliminate the factor of unpredictability in medical treatment; on the contrary, advances in medicine can sometimes make diagnosis and therapy even more random. In the context of robot-assisted surgeries, whether face-to-face or at a distance, the patient's informed consent acquires certain peculiarities, in view of the various random factors and risks inherent to the technology itself. Thus, the present work proposes to analyze the Brazilian, European and North American context, the risks and benefits associated with these technologies and the necessary content of information passed on to patients, as well as the forms of accountability and the quantification of damages by breach of the duty to inform.
