Este trabalho aborda o tema do tráfico de seres humanos em sua relação com o controle dos fluxos migratórios. O afluxo de imigrantes economicamente pobres e de prostitutas gera medo e insegurança nos lugares de destino, provocando ruídos no subsistema penal, que reage ao estímulo provocado pelo ambiente, por meio de políticas criminais expansionistas, centradas na prevenção geral positiva, na antecipação de riscos e no controle dos grupos criadores desses riscos. O artigo parte da hipótese de que o Direito Penal é utilizado como instrumento para a regulação da exclusão social. Por meio da análise de legislações antitráfico, objetiva-se averiguar se o Direito Penal do Inimigo se faz presente na confecção de programas político-punitivos volvidos no enfrentamento ao tráfico de pessoas.

This work discusses the theme of trafficking in human beings in its relation to the control of migration flows. The influx of poor economic immigrants and prostitutes generates fear and insecurity in destinations, provoking criminal subsystem noise, which reacts to the stimulation caused by the environment, by means of criminal policies, focused on general prevention expansionists positive, in anticipation of risks and in the control of those breeders risk groups. Part of the hypothesis that the criminal law is used as an instrument for the regulation of social exclusion through the analysis of anti-trafficking legislation, aims to ascertain whether the criminal law of the enemy is present in the package of political programmes-punitive later on counter trafficking in persons.
