A indústria musical contemporânea enfrenta desafios significativos relacionados à proteção e reivin-dicação dos direitos autorais, destacando-se a prática de regravar músicas como um meio de recuperar direitos conexos - fenômeno que recentemente ganhou notoriedade no caso da cantora Taylor Swift. Assim, importa compreender as nuances legais e estratégicas adotadas por artistas na era digital, bem como as implicações dessa prática para a indústria. A proposta do estudo é analisar os direitos conexos na Indústria da Música, realizando um estudo de caso de regravação de álbuns realizada pela cantora Taylor Swift, bem como um estudo comparativo entre as regulamentações no Brasil e nos Estados Unidos. Dessa forma, questiona-se: quais as modalidades legais no direito brasileiro e norte-americano que permitem resguardar os direitos conexos na indústria musical, e quais as diferenças e semelhanças entre suas regulamentações? Nesse sentido, o objetivo geral da presente pesquisa é ve-rificar as modalidades legais que garantem a proteção dos direitos conexos na indústria da música. A metodologia empregada é qualitativa, envolvendo procedimentos de revisão bibliográfica, bem como um estudo de caso para ilustração. Os resultados revelam que a regravação, quando realizada de forma estratégica, pode ser um meio eficaz de recuperar controle sobre obras musicais. No caso de Swift, a regravação de álbuns não apenas gerou repercus-sões financeiras, mas também trouxe à tona discussões sobre propriedade intelectual, fortalecendo sua posição como artista e influenciadora na indústria. Por outro lado, destaca-se que essa estratégia pode não ser viável para artistas emergentes, ressaltando a complexidade do cenário musical contemporâneo.
The contemporary music industry faces significant challenges related to the protection and claim of copyright, highlighting the practice of re-recording songs as a means of recovering related rights – a phenomenon that recently gained notoriety in the case of singer Taylor Swift. Thus, it is important to understand the legal and strategic nuances adopted by artists in the digital age, as well as the implications of this practice for the industry. The purpose of the study is to analyze the related rights in the Music Industry, performing a case study of album re-recording, such as performed by singer Taylor Swift, as well as a comparative study between the regulations in Brazil and the United States. Thus, it is questioned: what are the legal modalities in Brazilian and North American law that allow to safeguard the related rights in the music industry, and what are the differences and similarities between their regulations? In this sense, the general objective of this research is to verify the legal modalities that guaran-tee the protection of related rights in the music industry. The methodology used is qualitative, involving literature review procedures, as well as a case study for illustration. The results reveal that re-recording, when performed strategically, can be an effective means of regaining control over musical works. In the case of Swift, the re-recording of albums not only generated financial repercussions, but also brought up discussions about intellectual property, strengthening her position as an artist and influencer in the industry. On the other hand, this strategy may not be feasible for emerging artists, high-lighting the complexity of the contemporary music scene.
