A Lei n. 12.016/2009 trouxe algumas alterações importantes na matéria pertinente ao Mandado de Segurança Coletivo, esclarecendo sobre a legitimidade ativa e o objeto deste writ, e proporcionando a sua renovação. Entretanto, apesar do esforço legislativo, alguns aspectos desta garantia constitucional ainda geram dúvidas que precisam ser enfrentadas para que se possa obter a sua otimização, em especial no concernente ao seu procedimento e a sua eficácia.
Resumo Inglês:
The Law n. 12.016/2009 brought some important changes in the Collective Writ of Mandamus, providing greater insight into the active legitimacy and the object of this writ, as well its renewal. However, despite the legislative effort, some aspects of this constitutional guarantee still raise questions that must be addressed to achieve its optimization, particularly with regard to its procedure and its effectiveness.
