O conflito é inerente à espécie humana, uma vez que é natural do ser humano impor seus
desejos e a sua maneira de pensar. A existência de conflitos nas relações sociais possibilita
a evolução humana e as transformações na sociedade. Assim, a complexidade das rela-
ções conflituosas e a diversidade cultural presente na sociedade brasileira tornam evidente
a necessidade da utilização de práticas resolutivas alternativas ao sistema estatal de jurisdição.
O presente trabalho tem como escopo analisar os elementos constitutivos do conflito
no sentido genérico do termo, com o intuito de compreender a atuação do Estado em sua
resolução. Por meio de pesquisa bibliográfica e com a aplicação dos métodos fenomenológico
e comparativo, concluiu-se que o Estado demonstra-se ineficaz no tratamento dos
conflitos, diante da complexidade das relações sociais.
