O presente trabalho fará uma análise acerca das normas, princípios e regras com o objetivo de apontar as divergências entre os mais importantes princípios constitucionais no âmbito da legislação brasileira e da legislação internacional e a colisão entre eles, verificando a objeção de consciência por motivo religioso e o atrito entre os Códigos Civil e da medicina seguido do posicionamento dos hospitais. O tema é de bastante relevante, visto que se torna um assunto de interesse tanto para os advogados, bacharéis e magistrados, como para a população em geral. Portanto, este estudo mostrará posicionamento desse grupo religioso, apresentando os preceitos bíblicos adotados por ele, e os posicionamentos doutrinários e jurisprudenciais acerca do assunto, assim como a recusa a esse tipo de tratamento e suas alternativas. Por fim, apresentará elementos para a discussão sobre a referida problemática.

This piece of work will make an analysis of the norms,principles and rules involved in it and aims at highlighting the disagreements that exist amongst the main constitutional principles persuant to the Brazilian legislation and the international law and the conflict between these.We shall discussthe conscientious objection pertaining to a religious ground and the conflict between the Civil Codes and the Medical Codes,followed by the hospitals's stance on this subject.This is a very relevant theme and a topic of interest for solicitors,law graduates and magistrates alike as well as for the population as a whole.For this reason,this dissertation will show the stance which this religious group take and introduce the biblical precepts adopted by them,as well as the doctrinal stance and also by case law,which surround this subject and the refusal to this type of treatment and its alternatives. Finally, it will introduce the elements for a discussion about the referred matter.
