O texto aborda aspectos selecionados da primeira monografia abrangente sobre as interfaces entre a propriedade intelectual (IP) e lei de investimento internacional realizada por Simon Klopschinski. Contra o pano de fundo de uma arbitragem relacionada a investimento, onde uma empresa de tabaco alega que as medidas australianos restringem o uso de marcas em maços de cigarro (embalagem simples) violando a lei do investimento internacional, a próxima seção serve como uma ilustração em torno das controvérsias atuais envolvendo a Propriedade Intelectual e proteção do investimento. O segundo foco deste artigo baseia-se na questão de como determinar a relação entre as normas de Direito Internacional de Investimento com as de Direito de Propriedade Intelectual. Esta questão transversal - levantando questões gerais sobre as interfaces entre áreas distintas do direito internacional - vai determinar, em grande medida, a relevância prática de proteger direitos de propriedade intelectual sob a lei de investimento internacional.

This review addresses selected aspects of the first comprehensive monograph on the interfaces between intellectual property (IP) and international investment law by Simon Klopschinski. Against the background of an ongoing investment arbitration where a tobacco company claims that Australian measures restricting the use of trademarks on cigarette packs (plain packaging) violates international investment law, the next section serves as an illustration of current controversies about IP and investment protection. The second focus of this article rests on the question how to determine the relationship between the norms of International Investment Law with those of international IP Law . This cross-cutting issue – raising general questions about the interfaces between distinct areas of international law - will determine to a large extent the practical relevance of protecting IP rights under international investment law.
