O presente trabalho pretende estabelecer articulações entre Direito e Literatura, valendo-se do conto "Mineirinho" de Clarice Lispector. A contista declarou ter se transmudado no próprio criminoso "Mineirinho", morto pela polícia com treze tiros - "qualquer que houvesse sido o crime, apenas uma bala bastava, o resto era vontade de matar, prepotência". A intenção do presente trabalho é fornecer algumas contribuições do Direito para pensar no que consistiria esse ato desarrazoado de violência. Buscou-se caracterizá-la em seu grau puro, aquela injustificável dentro de parâmetros de justiça e direito. Walter Benjamin, no ensaio "Crítica da Violência - Crítica do Poder", sugere que estáá no próprio cerne do Direto a violência em sua forma mais pura. É por esse caminho que seguirá esta reflexão, num tempo marcado pela guerra, violência e genocídio.
This paper aims to establish links between law and literature, drawing on the short story "Mineirinho" written by Clarice Lispector. The writer claimed to have transmuted the criminal herself. "Mineirinho”, who was killed by the police with thirteen shots -"for any crime, only one bullet was enough, therest were wish to kill, arrogance." The intention of this paper is to provide some contributions from law to think about the aspects of this unreasonable act of violence, the violence on pure degree, that unjustifiable within the parameters of justice andlaw. Walter Benjamin, in his essay "Critique of Violence - Critique of Power," suggests that is the very heart of the law – violence- in its purest form. It is this path that this reflection, a time and world signalized by war, violence and genocide.
