POR UMA CRÍTICA IMANENTISTA À TEORIA DA SOBERANIA

Resumo Português:

O presente trabalho pretende uma crítica imanentista da teoria
da soberania. Esta ainda se orienta por um matiz essencialmente
moderno, tendo como principais referências autores tais como Jean
Bodin e Thomas Hobbes. Para além do nível teórico, manifesto na sua
proeminência nas teorias de relações internacionais, é esta mesma
concepção que norteia a prática jurídica internacional. O que
pretenderemos demonstrar é que a teoria da soberania ao se voltar para
uma análise essencialmente transcendente do poder tomando-o como
algo emanando de um centro – o soberano, o Direito, o Estado – perde a
capacidade de uma análise efetiva do exercício do poder. A partir da
filosofia de Michel Foucault procuraremos demonstrar como o poder é
um campo imanente e relacional, ao qual, produz, de modo derivado,
instituições e discursividades tais como a própria teoria da soberania e o
poder do Estado. Em seguida, procuraremos demonstrar como a teoria
da soberania se vincula a um modo prático de exercício do poder
diferente do em voga atualmente, e a razão de sua persistência a nível
teórico, jurídico e discursivo.

Resumo Inglês:

In the present paper we will intend to make a
immanentist critic of the sovereignty theory. It still orients herself
through a modern basis, having as its main references authors
such as Jean Bodin and Thomas Hobbes. Beyond the theoretical
level, expressed in the international relations theory mainstream,
it is that same conception that directs the international juridical
practice. What we intend to demonstrate is that the sovereignty
theory, as it turns to an essentially transcendent analysis of power,
taking it as something emanating of a center– the Sovereign, the
Law, the State – it undermines its effective capacity of analyzing
the real exercise of power. Through Michel Foucault's philosophy
we shall see how power is an immanent and relational field which
produces, in derivative mode, institutions and discourses as the
sovereignty theory itself and the power of State. Following, we
seek to demonstrate how sovereignty’s theory is associated with a
particular practical mode of power exercise, different from the
actual mode, and the reason of its permanence in a discursive,
theoretical and juridical level.
