Sob um olhar em perspectiva para a relação entre o Instituto do Patrimônio Histórico e Artístico Nacional (IPHAN) e o Patrimônio Cultural Afro-brasileiro, o objetivo deste texto é promover uma reflexão que nos permita compreender em que medida o Registro de Bens Culturais de Natureza Imaterial (IPHAN, 2000) contribui para a valorização do Patrimônio Cultural Afrobrasileiro nos últimos 20 anos. A partir da análise dos processos de registro do Ofício das Baianas de Acarajé (IPHAN, 2004) e da Capoeira como Patrimônio Cultural do Brasil (IPHAN, 2008), identificamos as narrativas construídas pela patrimonialização desses bens culturais e as consequentes práticas da inserção desses bens no patrimônio cultural nacional. As considerações aqui apresentadas fazem referência a um exercício importante de reflexão a respeito dos impactos da política pública de patrimônio imaterial sobre os processos de valorização e de reconhecimento das formas de expressão, e dos saberes e das celebrações criados e transmitidos de geração em geração pelas populações afro-brasileiras. Mesmo sinalizando avanços desse instrumento jurídico na valorização das referências culturais negras, frisamos ainda haver limitações decorrentes da dissociação das políticas patrimoniais de uma discussão mais ampla sobre racismo, considerando-se, sobretudo, seus mecanismos de exclusão, de extermínio, de criminalização e de invisibilização tanto de pessoas negras quanto de suas formas de realização cultural.

Under a perspective look at the relationship between the National Historical and Artistic Heritage Institute (IPHAN) and the Afro-Brazilian Cultural Heritage, the purpose of this text is to promote a reflection that allows us to understand to what extent the Registration of Cultural Goods of Immaterial Nature (IPHAN, 2000) contributes to the valorization of Afro-Brazilian Cultural Heritage in the last 20 years. From the analysis of the registration processes of the Craft of the Baianas of Acarajé (IPHAN, 2004) and of Capoeira as Cultural Heritage of Brazil (IPHAN, 2008), we identified the narratives constructed by the patrimonialization of these cultural goods and the consequent practices of the insertion of these goods in the national cultural heritage. The considerations presented here refer to an important exercise of reflection on the impacts of public policy on intangible heritage on the processes of valuing and recognizing the forms of expression, and the knowledge and the celebrations created and transmitted from generation to generation by Afro-Brazilian populations. Even signaling advances in this legal instrument in the valorization of black cultural references, we emphasize that there are still limitations resulting from the dissociation of heritage policies from a broader discussion on racism, considering, above all, its mechanisms of exclusion, extermination, criminalization and invisibility both black people and their forms of cultural achievement.
