A presente pesquisa visa analisar os impactos da decisão da Corte Especial do Superior Tribunal de Justiça, no que tange a declaração de taxatividade do rol da Agência Nacional de Saúde Suplementar. Desse modo, preliminarmente, fez-se uma explanação sobre o acesso à saúde no Brasil, evidenciando a importância e a distinção entre saúde suplementar e complementar, bem como seu marco inicial. Por conseguinte, com base nos dispositivos legais, apresentou-se a regulamentação dos planos de saúde em âmbito nacional, e o papel crucial da ANS. Ademais, fez-se a análise da Lei que dispõe sobre os planos e seguros privados de assistência à saúde. Posteriormente, foi exposta a decisão da Segunda Seção do Superior Tribunal de Justiça, a fundamentação de tal entendimento, e o controle de constitucionalidade que paira sobre o mesmo. Trata-se de uma pesquisa exploratória, bibliográfica e documental, de abordagem qualitativa. Nesse ínterim, o objetivo desse trabalho é fomentar as consequências trazidas pela taxatividade do rol de procedimentos e medicamentos da ANS, elucidando os prejuízos causados aos consumidores dos planos de saúde.
The present research aims to analyze the impacts of the decision of the Special Court of the Superior Court of Justice, regarding the declaration of exhaustiveness of the role of the National Agency of Supplementary Health. Thus, preliminarily, an explanation was made about access to health in Brazil, highlighting the importance and distinction between supplementary and complementary health, as well as its initial landmark. Therefore, based on the legal provisions, the regulation of health plans at the national level was presented, and the crucial role of the ANS. In addition, the Law that provides for private health care plans and insurance was analyzed. Subsequently, the decision of the Second Session of the Superior Court of Justice, the reasoning of such understanding, and the control of constitutionality that hovers over it were exposed. This is an exploratory, bibliographic and documentary research, with a qualitative approach. In the meantime, the objective of this work is to promote the consequences brought about by the exhaustive list of procedures and medicines of the ANS, elucidating the damage caused to consumers of health plans.
