O artigo retrata, de forma sintética, a divergência existente entre a decisão da ADPF 153 do STF em recepcionar a Lei da Anistia e a deliberação da Corte Interamericana de Direitos Humanos que declarou que as Anistias são contrárias à proteção dos Direitos Humanos. Para tanto, serão delineados comentários sobre as políticas de transição existentes, como os julgamentos e as anistias. Inclusive, analisaremos alguns desses modelos e se foram bem-sucedidos. O objetivo deste artigo é avaliar qual a melhor forma para se chegar à paz e à democracia, se é que existe alguma. Por fim, a pesquisa, para se chegar ao presente artigo, foi realizada em revistas, periódicos e livros.
Resumo Inglês:
The article summarizes the divergence between the decision of the STF’s ADPF 153 to accept the Amnesty Law and the decision of the Inter-American Court of Human Rights, which declared that amnesties are contrary to the protection of human rights. Therefore, comments on existing transition policies, such as trials and amnesties, will be outlined. We will even analyze some of these models and whether they have been successful. The purpose of this article is to assess what is the best way to achieve peace and democracy, if there is any. Finally, the research to arrive at this article was carried out in magazines, periodicals and books.
