Este artigo se utilizou do método indutivo partindo de pesquisas bibliográficas e pretende tratar sobre a aplicação da legislação dos Direitos Fundamentais do idoso no Brasil. Dessa forma, para melhor compressão do texto, mostrou-se útil traçar um comparativo entre a Constituição de 1988 com a de outros países, bem como com as Cartas Magnas brasileiras anteriores. Além disso, discorreu-se sobre os Direitos dos idosos antes do Estatuto do Idoso e destacou-se os principais Direitos Fundamentais previstos neste último e a suas aplicações atualmente no país.
Resumo Inglês:
This article uses the inductive method based on bibliographical research and intends to deal with the application of the legislation of Fundamental Rights of the elderly in Brazil. Thus, to better understand the text, it was useful to draw a comparison between the 1988 Constitution and that of other countries, as well as with the previous Brazilian Magnes Letters. In addition, the Rights of the Elderly were discussed before the Statute of the Elderly and highlighted the main Fundamental Rights foreseen in the latter and its applications currently in the country.
