O presente artigo trata da aplicação, no direito brasileiro, de elementos da família jurídica da common law quanto ao tema dos precedentes vinculantes. Assim, inicialmente, faz uma breve análise do sistema da common law e da civil law, para então aprofundar no instituto da stare decisis. Após, realiza exposição sobre como a doutrina dos precedentes vinculantes vem sendo aplicada no Brasil, antes e depois da Lei 13.105/2015. Por fim, baseado nos elementos analisados até então, conclui no sentido de que nosso ordenamento se beneficiaria de sua utilização como ferramenta para alcançar a justiça social, a segurança jurídica, o tratamento isonômico entre os cidadãos e a celeridade processual.

The present work is about the possibility of applying elements of the common law institute in the Brazilian Law related to the stare decisis. Thus, initially, it makes a brief analysis concerning the concept and the origins of the common law and the civil law, especially as regards as the stare decisis. In a second moment, this paper examines how the stare decisis doctrine is being applied in the Brazilian Law, particularly in relation to the new Civil Procedure Code. Finally, the present article, based on the various elements mentioned throughout the work, develops a conclusion in the sense of that our legal system would be improved by the use of the stare decisis doctrine as a tool in order to achieve the social justice, the legal security, the equality among citizens and the legal celerity.
