A busca por um tratamento eficaz para a COVID-19 traz à tona uma série de implicações jurídicas no que tange à liberdade de escolha do indivíduo frente às práticas médico-científicas vigentes. Nesse sentido, o presente estudo investiga de que modo a dogmática, a doutrina e a jurisprudência pátrias vêm respaldando as escolhas individuais, num cenário de incertezas, quanto aos recursos terapêuticos colocados à disposição para enfrentamento do novo coronavírus. Sob a ótica do princípio bioético da autonomia do paciente e do comando constitucional da preservação da integridade física, analisa-se a legitimidade de recusa ao tratamento, as vulnerabilidades resultantes da pesquisa por vacinas, bem como o uso de fármacos off-label no tratamento da doença. Questiona-se a finalidade, alcance e legitimidade do Termo de Consentimento Livre e Esclarecido (TCLE) para a realização de procedimentos médicos específicos. Derradeiramente, perquire-se apreciar a coexistência da autonomia do indivíduo com a dimensão transindividual de interesses tutelados sob o enfoque de políticas de prevenção e/ou combate a pandemias. A pesquisa emprega o método dedutivo, com abordagem qualitativa dos registros levantados, com vistas a contribuir para a compreensão da liberdade no contexto da política sanitária.
The search for an effective treatment for Covid-19 brings to light several legal implications regarding the individual’s freedom of choice in the face of cur-rent medical-scientific practices. In this sense, the present study investigates how brazilian’s dogmatics, doctrine and jurisprudence have been supporting individual choices, in a scenario of uncertainty, regarding the therapeutic resources made available to face the new coronavirus. From the perspective of the bioethical principle of patient autonomy and the constitutional command to preserve physical integrity, the legitimacy of refusing treatment is analyzed, the vulnerabilities resulting from vaccine research, as well as the use of off-label drugs in the disease’s treatment. The purpose, scope and legitimacy of the Free and Informed Consent Term for the per-formance of specific medical procedures are questioned. Ultimately, it is necessary to appreciate the coexistence of the individual’s autonomy with the transindividual dimension of interests protected under the focus of policies to prevent and/or combat pandemics.
