Este artigo tem como objetivo analisar alguns aspectos do discurso atual do Direito
brasileiro. Apoiando-se em pressupostos teóricos do lingüista russo Mikhail Bakhtin (1895-
1975), segundo os quais a linguagem é instância ideológica por excelência, presentes na obra
Marxismo e filosofia da linguagem, procuramos avaliar a linguagem jurÃdica como expressão
do componente ideológico. Para tanto utilizamos um modelo de petição jurÃdica colhido em
um guia para advogados, o qual nos serve como corpus representativo da linguagem forense.
This article has as objective to analyze some aspects of the current speech of the
Brazilian Right. Supporting itself in estimated theoreticians of Russian linguist Mikhail
Bakhtin (1895-1975), according to which the language is ideological instance par excellence,
gifts in the work Marxism and philosophy of the language, we look for to evaluate the legal
language as expression of the ideological component. For this we use legal petition model
collected in a guide for lawyers, which serves us as representative corpus of the forensic
language.
