Atualmente existe uma alta gama literária acerca da educação no contexto legislativo, contudo pouco se discute acerca dos sentidos fundamentais da educação, a sua natureza e consequências. Com o presente artigo, objetiva-se analisar a legislação estipulada em diversos atos normativos que permeiam o direito à educação de qualidade, bem como Lei de Diretrizes e Bases da Educação – LDB 9.394/96, Base Nacional Comum Curricular e Constituição Federal, que definem os pressupostos para a educação e sua aplicabilidade no ambiente escolar. Em função disso, propõe-se a caracterização o direito a educação como um direito fundamental, responsável pelo desenvolvimento da pessoa humana e consequente desenvolvimento social.

There is currently a high literary range about education in the legislative context, yet little is discussed about the fundamental meanings of education, its nature and consequences. This article aims to analyze the legislation stipulated in many normative acts that permeate the right to quality education, as well as the Law of Guidelines and Bases of Education - LDB 9.394/96, Common National Curricular Base and Federal Constitution, which define the assumptions for education and its applicability in the school environment. Therefore, it is proposed to characterize the right to education as a fundamental right responsible for the development of the human being and consequent social development.
