O objetivo geral do artigo é evidenciar a importância da tutela administrativa do con sumidor em um contexto no qual o mercado se encontra fortemente influenciado pela tecnologia da informação. Com o emprego da metodologia argumentativa, foi possível concluir que a eco nomia praticada de forma compartilhada é no seu âmago um negócio, o que implica dizer que sempre haverá uma {ou mais) parte vulnerável envolvida. A dignidade e a autonomia da vonta de do consumidor devem ser preservadas, sendo o processo administrativo importante garantia constitucional na defesa dessa categoria de vul nerável. Com efeito, independentemente de como o mercado se apresenta atualmente,a amplitu de da processualidade administrativa e o vigente perfil instrumental do exercício da função pública permitem a efetiva participação das partes na in tervenção estatal do mercado de consumo, pelo que se constroem relações econômicas, tecnoló gicas e jurídicas mais seguras, plurais e confor madoras de direitos fundamentais. reflexo de um Estado Democrático de Direito.

The overall aim of this article isto high light the importance of consumer protection in a context that market is strongly influenced by in formation technology. By using the argumentati ve method ofresearch, itwas possible to conclude that sharing economy is, at its core, a business, which implies that there will always be one (or more) vulnerable part involved. he dignity and thefreedom of will of the consumers must bepre served and the administrative process is a reliable constitutional guarantee in the defense of this vu 1nerable category.Indeed, regard1essof how the market presents itself, the amplitude of adminis trative processua lity andthe current instrumenta 1 profile of the exercise of the public function allow the effective participation of the parties in the government intervention of the consumer market, wherefore economic, technological and legal relationships are built up more secure, plural and fundamental rightsconformance, reflecting a De- mocratic Rule of L.aw.
