Diante de uma conjuntura neoconstitutional que se propõe a superar a legalidade estritamente positivista por meio da valorização dos princípios constitucionais, o Poder Judiciário se torna o protagonista do sistema, a ele competindo a definição de cláusulas abertas e a interpretação da Constituição. Muitos desafios surgem a partir daí, impondo-se a necessidade de definir os limites da atuação dos magistrados, especialmente frente ao parlamento. Tal definição mostra-se essencial para o próprio conceito de democracia, vez que a nova dimensão atribuída ao Poder Judiciário já não se adéqua à visão clássica de democracia, compreendida como o governo do povo. Nesse novo contexto, a democracia passa a ser acrescida de conteúdos materiais inafastáveis, cuja defesa está a cargo dos juízes, principais responsáveis pelo controle dos demais poderes do Estado. O objetivo desse artigo é definir o papel dos magistrados e da decisão judicial no Estado Democrático de Direito, a fim de que possam contribuir para a evolução do sistema jurídico. O método de pesquisa utilizado é o bibliográfico e documental.

Faced with an environment neoconstitutional, which aims to overcome the strict legal positivist through optimization of the constitutional principles, the Judiciary is the protagonist of the system, competing with it the definition of terms and open interpretation of the Constitution. Many challenges arise from that, imposing the necessity to define the limits of performance of judges, especially against the parliament. This definition seems to be essential to the concept of democracy, as the new dimension given to the Judiciary no longer fits the classical view of democracy, understood as the government of the people. In this new context, democracy becomes more of content material inafastáveis, whose defense is the responsibility of judges, mainly responsible for the control of other branches of government. The purpose of this article is to define the role of judges and the judicial decision in the Democratic State of Law, so that may contribute to the development of the legal system. The research method used is bibliographical and documentary.
