O presente estudo propõe uma investigação sobre o recente acórdão do Supremo Tribunal Federal exarado no Mandado de Injunção 4.733, no qual o Tribunal, ao considerar a mora inconstitucional do Congresso Nacional, equiparou as condutas homofóbicas e transfóbicas ao crime de racismo previsto na Lei 7.716/1989. Para tanto, foi analisado se a decisão desrespeitou o princípio da legalidade em matéria penal, o alcance dado pelo Tribunal aos mandamentos constitucionais de criminalização, o alcance, em termos de política criminal, da decisão e os desafios ainda existentes para que a comunidade LGBT tenha os seus direitos respeitados. Esses aspectos foram abordados a partir da Ação Constitucional do Mandado de Injunção e o seu desenvolvimento histórico e social, em especial, depois do advento da Lei 13.300/2016.

This article proposes an investigation into the recent Federal Supreme Court ruling in Injunction Order 4733, in which the Court, when considering the unconstitutional default of the National Congress, equated homophobic and transphobic conduct to the crime of racism provided for in Law 7716/1989. To this end, it was analyzed whether the decision disrespected the principle of legality in criminal matters, the scope given by the Court to the constitutional mandates of criminalization, the scope, in terms of the criminal policy of the decision and the challenges that still exist for the LGBT community to have their rights respected. These aspects were addressed from the Constitutional Action of the Injunction Order and its historical and social development, especially after the advent of Law 13.300/2016.
