Vivemos em um mundo sem fronteiras que trouxe novas questões a serem enfrentadas no que se refere ao universo da internet. Uma delas é a potencial necessidade da atuação jurisdicional para além dos estritos limites da formal jurisdição, haja vista a imprescindibilidade da eficácia das decisões judiciais. O desafio que emerge dessa nova abordagem é relevante, porque a abrangência extraterritorial de uma decisão judicial pode, muitas vezes, impactar aspectos relacionados à soberania. O direito, entretanto, precisa amoldar-se aos novos tempos e estabelecer parâmetros aceitáveis para a solução de tal impasse. O presente estudo trata da extraterritorialidade das decisões judiciais.
We live in a world without frontiers that has brought new issues to be faced with regard to the universe of the Internet. One of these is the potential need for judicial action beyond the strict limits of the formal jurisdiction, given the indispensability of the effectiveness of the judicial decisions. The challenge that outcomes from this new approach is relevant because the extraterritorial scope of a court decision may impact the sovereignty. The law, however, needs to conform to new times and establish acceptable parameters for the solution to such standoff. The present study deals with the extraterritoriality of judicial decisions.
