Este artigo pretende analisar o processo de esclerose do escravismo no Brasil a partir das transformações verificadas no Direito e na atuação da magistratura na segunda metade do século XIX. Assume que o Direito é uma instância condicionada pelas relações sociais. A sua evolução revela as tendências e as contradições sociais inerentes à lenta débâcle do escravismo no Brasil.
This article intends to analyze the process of sclerosis of the slavery in Brazil from the transformations of the Law and in the performance of the magistracy verified in the second half of century XIX. It assumes that the Law is a conditioned instance for the social relations. Its evolution discloses the trends and the social contradictions that are inherent in slow débâcle of the slavery in Brazil.
