Este trabalho tem como objetivo discutir e analisar o direito à educação escolar básica dos estudantes imigrantes que residem no Estado de São Paulo. Para tanto, o foco dessa investigação foi a análise da legislação paulista sobre o direito à educação e a inclusão das crianças imigrantes nas escolas da rede pública do estado de São Paulo. Como procedimento metodológico realizou-se levantamento bibliográfico de pesquisas publi-cadas e da legislação paulista relativa ao direito à educação do estudante imigrante. Para compreender como o direito à educação se manifesta nos mecanismos legais do Estado de São Paulo, optou-se pela técnica de análise de conteúdo. A partir dos resultados e discussões apresentados, foi observado uma transformação das leis estaduais paulistas na busca de equiparação de direitos entre o estudante regular e o imigrante no processo de inserção na rede estadual de ensino.

This work aims to discuss and analyze the right to basic school education of immigrant students residing in the State of São Paulo. To this end, the focus of this investigation was the analysis of São Paulo legislation on the right to education and the inclusion of immigrant children in public schools in the state of São Paulo. As a methodological procedure, a bibliographical survey of published research and São Paulo legislation relating to the right to education of immigrant students was carried out. To understand how the right to education manifests itself in the legal mechanisms of the State of São Paulo, we opted for the content analysis technique. From the results and discussions presented, a transformation of São Paulo state laws was observed in the search for equal rights between regular students and immigrants in the process of insertion into the state education network.
