Resumo Português:
O presente trabalho tem como objetivo desenvolver um estudo acerca do diálogo jurídico entre o direito à educação sob a ótica dos direitos e garantias fundamentais. A despeito da educação, delimitou-se a formas inclusivas para os portadores de limitação do tipo física ou mental. Sob a perspectiva de um Estado garantidor, e com fundamento na dignidade da pessoa humana, não se pode admitir à exclusão de determinadas pessoas a educação, sob pena de o Estado ser classificado como inaceitável violador das garantias constitucionais. Como método da pesquisa, adotou-se o dedutivo e como metodologia optou-se pela bibliográfica e algumas legislações.

The present work aims to develop a study about the legal dialogue between the right to education from the point of view of fundamental rights and guarantees. In spite of the education, it was delimited to inclusive forms for the people of limitation of the physical or mental type. From the perspective of a guarantor State, and based on the dignity of the human person, education can not be excluded from certain persons, otherwise the State will be classified as an unacceptable violator of constitutional guarantees. As method of research, the deductive was adopted and as methodology was chosen by bibliographical and some legislation.
