O DEVER DO ESTADO DE AUTORIZAR E CONTROLAR A PRODUÇÃO DE ALIMENTOS TRANSGÊNICOS

Resumo Português:

O objetivo desta pesquisa é o de analisar as regras jurídicas brasileiras no tocante às responsabilidades do Estado, poder/ dever, seja na autorização ou na fiscalização da produção de alimentos transgênicos. A metodologia utilizada nessa pesquisa é a do método dedutivo; quanto aos meios a pesquisa foi bibliográfica e quanto aos fins, qualitativa. A conclusão a que se chegou foi a de que o Estado brasileiro, ao fazer publicar a Lei nº 11.205/2005 que regulamenta a produção, distribuição e descartes de alimentos transgênicos, estabeleceu mecanismos de controle para o próprio Estado, impondo-se a ele uma postura pró ativa da qual, se descumprir, será responsabilizado, uma vez que o cidadão brasileiro deve ser tutelado pelo Estado quer no âmbito da saúde alimentar, quer no âmbito de um meio ambiente ecologicamente equilibrado.

Resumo Inglês:

The objective of this research is to analyze the Brazilian legal rules regarding the State’s responsibilities, power/duty, whether in the authorization or inspection of the production of transgenic foods. The methodology used in this research is the deductive method; as to the means, the research was bibliographical and as to the ends, it was qualitative. The conclusion reached was that the Brazilian State, when publishing Law No. 11.205/2005 that regulates the production, distribution and disposal of transgenic food, established control mechanisms for the State itself, imposing a a proactive posture which, if he does not comply, he will be held responsible, since the Brazilian citizen must be protected by the State both in the context of food health and in the context of an ecologically balanced environment.
