O Descabimento da Imunidade Tributária Recíproca em Face da Correios Celular sob o Prisma do Princípio da Livre Concorrência

A imunidade tributária recíproca dispõe ser vedado à União, aos estados, ao Distrito Federal e aos municípios instituir impostos sobre patrimônio, renda ou serviços, uns dos outros (art. 150, VI, “a”, da CF/1988). Contudo, seu escopo é limitado pelo § 3º do art. 150, da CF/1988. A exceção prevista neste dispositivo ensejou o surgimento de uma concepção teórica que defende o descabimento da imunidade tributária recíproca em face de empresas públicas que exploram atividades econômicas em que haja atuação direta de agentes privados, tendo em vista que tal benefício tributário desequilibraria a concorrência em favor do ente estatal, contrariando diretamente ao princípio da livre concorrência. Assim, tendo em vista que os negócios da Correios Celular extrapolam as atividades relacionadas ao serviço postal, é perfeitamente cabível afirmar que a EBCT, ao ofertar os serviços da Correios Celular, desempenha atividade eminentemente econômica e, portanto, não deve fazer jus aos benefícios relativos à imunidade tributária recíproca.

The reciprocal immunity in CF/1988 establishes that the Federal Government, the states, the Federal District and municipalities are not allowed to impose taxes on property, income or services of each other (article 150, VI, “a”, CF/1988). However, its scope is limited by § 3 of art. 150, CF/1988. This exception led to theoretical conception that defends the disregard of reciprocal tax immunity of public companies that exploit economic activities in which there is direct action of private agents, considering that the concession of this benefit would unbalance the competition in favor of such state entity, what would directly confront the principle of free competition. Thus, considering that the businesses developed by Correios Celular extrapolate the activities related to the postal service, it is perfectly reasonable to state that EBCT, by offering the services of Correios Celular, performs economic activity and, therefore, not entitled to the reciprocal immunity conferred on EBCT.
