O presente trabalho objetiva discutir, de forma breve, a interferência do Poder Judiciário na consecução da política pública no sistema carcerário brasileiro, haja vista decisões do Supremo Tribunal Federal, as quais reconheceram o Estado de Coisas Inconstitucional. Nestes termos, buscou-se analisar a possível quebra do princípio da separação dos poderes, em razão da atuação preponderante do Judiciário.
Resumo Inglês:
This paper aims to discuss briefly the interference of the Judiciary in the pursuit of public policy in the Brazilian prison system, given decisions by the Federal Supreme Court, which recognized the State of Things Unconstitutional. In these terms, it was tried to analyze the possible breach of the principle of the separation of powers, in view of the preponderant action of the Judiciary.
