O presente artigo tem por objeto a necessária distinção que deve ser feita entre os crimes de corrupção passiva e concussão, tendo como referência o comportamento do particular. É comum o agente público usar de sua função para obter vantagem indevida sobre o particular, que muitas vezes sucumbe à exigência para evitar danos irreversíveis. No entanto, muitas vezes, a exigência é confundida com a solicitação e o particular, ao invés de ser considerado vítima, é tratado como autor de corrupção ativa.

The purpose of this article is to make the necessary distinction that must be made between crimes of bribery and concussion, with reference to the behavior of the individual. It is common for officials to use their function to obtain an undue advantage over the individual, who often succumbs to the requirement to avoid irreversible damage. However, the requirement is often confused with the request and the individual, rather than being considered a victim, is treated as the author of bribery.
