Este artigo pretende refletir sobre o Manicômio Judiciário a partir da perspectiva genealógica de análise, proposta por Michel Foucault. O caminho proposto pelo viés genealógico nos conduz a uma leitura das relações de saberpoder que atravessam a instituição em análise e, com isto, rompe-se com uma leitura linear e sem a marca das lutas nos processos que singularizam a experiência dos trabalhadores (as) nestes espaços. Neste texto, em específico, iniciamos nossa problematização chamando a fala e dando visibilidade a uma questão central: se for verdade que os contratos humanos atendem às necessidades de um tempo, ou seja, “constroem instituições”, que contrato é esse que se dá nos manicômios judiciários, hoje chamados institutos psiquiátricos forenses? Se as instituições dizem de quem somos nós, quem somos esse nós que se representa por essa instituição? Neste horizonte, tomamos o Manicômio Judicial, de forma geral, como um dispositivo que faz ver e falar, mas também, faz não ver e calar as forças que se configuram neste espaço. Neste texto se fala, principalmente, desde o lugar do psicólogo(a) num espaço tão marcado pelo discurso jurídico e médico. Acenamos para a idéia do Manicômio Judiciário como um dispositivo de criminalidade, a luz de como o define Cristina Rauter.

This article reflects on the Judiciary Mental Hospital from the perspective of a genealogic analysis proposed by Michel Foucault. The genealogic approach makes us go through a study of the relations knowledge-power that cross the institution in analysis, breaking a linear reading that does not contemplate the battles in processes that singularize the experience of workers in these fields. In this article, most specifically, we begin our investigation giving voice and visibility to a fundamental question: If it is true that contracts between humans meet the needs of a certain time
in history, which means, “build institutions”, what kind of contract is the one existing in Judiciary Mental Hospitals? If the institutions tell us who we are, who exactly is the subject represented by this institution? In this frame of reference, the Judiciary Mental Hospital in general is taken as a device that enables voice and visibility, but, on the other hand, never ceases to weaken and obstruct forces inhabiting this space. Above all, this article discusses mainly, the position of the psychologist in an institution in which the medical and legal discourses are so remarkable.
We also bring the idea of a Judiciary Mental Hospital as a device of criminality, as suggested and defined by Rauter.
