O presente artigo tem como objetivo, expor uma análise acerca do desenvolvimento de concepções de direito destinadas ao tratamento de indivíduos portadores de transtorno mental, da Idade Média até os dias atuais. Tal iniciativa torna-se relevante pelo fato de proporcionar percepções no que concerne às diversas formas interpretativas construídas no seio da sociedade sobre uma problemática jurídico - sociológica. Com isso, o entendimento da forma em que as diversas instituições jurídicas ou sociais interpretavam o fenômeno relacionado ao doente mental levavam à espontânea elaboração de interpretações em torno do fato.
This article aims to expose an analysis of the development of legal concepts for the treatment of individuals with mental disorders, from the Middle Ages to the present day. This initiative becomes important, because it provides insights into the various interpretative ways constructed within the society regarding legal-sociological problems. Thus, understanding the way according to which the various legal or social institutions interpreted the phenomenon related to mental patients led to the spontaneous development of interpretations of this fact.
