Resumo Português:

O tratamento destinado aos chamados loucos infratores,
aqueles indivíduos considerados incapazes pelo ordenamento
jurídico por possuir deficiência mental e que cometem delitos, é
muitas vezes ineficaz e negligente no tocante à proteção e
garantia dos direitos humanos. Os loucos infratores são
encaminhados por meio de medidas de segurança aos manicômios
judiciários, locais mantidos pelo sistema penitenciário brasileiro que
tem como objetivo tratar o doente mental a fim de promover sua
ressocialização. Porém, na realidade, muitos manicômios judiciários
tornaram-se locais de grandes violações aos direitos humanos,
executando práticas de tortura e tratamento desumano ou
degradante ao individuo e piorando sua deficiência. Este artigo visa
promover uma discussão sobre o incapaz deficiente mental, através
de um levantamento histórico sobre a loucura no Brasil, uma análise
ao adentrar dos manicômios judiciários a fim de propor medidas
alternativas ao tratamento do doente mental que efetivem a
ressocialização.



Resumo Inglês:

The treatment destined to the mental disturbed infractors,
those who are considered as incapable by the juridic order and that
due to their mental illnesses comitted delicts, is for several times
ineffective and negligent when it comes to the human rights. They
are referred by means of security to judiciary mad-houses, places
that are kept open by the brazilian penitentiary sistem with the
finality of treat the mentally distubeds in order to promote their resocialization. However, many judiciary madhouses have become
places of great violation of the Human Rights, executing practices of
torture and inhumane treatment or degrading to the subject,
making his illness in fact much worse. This article intends to promote a
discussion on the subject of the mentally disturbed incapable, by
raising data on the history of the treatment of madness in Brazil, an
analysis of the interior of the judiciary mad-houses with the finality of
offer alternative measures that would have more effect on the
resocialization of the mentally disturbed.
