Os direitos fundamentais consagrados historicamente são recepcionados e positivados pelo
constituinte originário na Carta Magna de 1988, conferindo aos indivíduos uma posição jurídica de
direito subjetivo, tanto no aspecto material quanto no seu aspecto processual. A consequência precípua
dessa positivação constitucional é o reconhecimento de seu caráter essencial para a concretização dos
preceitos elencados pelo constituinte originário, para o desenvolvimento do Estado democrático de
Direito. Nesse contexto, o presente trabalho visa analisar o direito fundamental ao meio ambiente
sadio e equilibrado e sua concretização na legislação infraconstitucional. Isto porque, o caráter amplo
e abstrato dos direitos fundamentais confere ao legislador ordinário políticas que consubstanciam os
direitos previstos na Carta Magna nacional. A referida análise será realizada observando o mecanismo
de logística reversa apresentado pela Política Nacional dos Resíduos Sólidos.

The fundamental rights enshrined historically positivized and are greeted by the original
constituents in the Magna Carta of 1988, giving individuals a subjective right of the legal position,
both in the material and in its procedural aspect. The consequence of this major duty is positive
constitutional recognition of their essential nature to achieve the principles listed by the original
representative, for the development of a democratic state of law. In this context, this study aims to
examine the fundamental right to healthy environment, balanced, and its realization in the infraconstitutional legislation. This is because the broad and abstract nature of the fundamental rights
conferred by the ordinary legislator policies that embody rights under the national Constitution. This
analysis will be performed by looking at the mechanism of reverse logistics presented by the National
Solid Waste
