Em 2020, houve uma virada no cenário da litigância climá-tica brasileira. Um movimento que vinha ganhando força em tribu-nais internacionais e de outros países continuava pouco expressivo e diluído no Brasil, um grande emissor de gases de efeito estufa (GEE). No entanto, o surgimento de novos casos brasileiros que abordem as mudanças climáticas diretamente abre mostra uma nova possibilidade de combate à crise climática e um possível aumento no engajamento com o tema. Este trabalho se propõe, por meio de revisão literária, a analisar a posição brasileira no fenômeno global da litigância climática e seu contexto interno. Para isso o texto se divide em: i) introdução geral sobre a litigância climática e a urgência de ações; ii) contexto interno e jurisprudências relevantes; iii) características dentro do con-texto global; iv) instrumentos jurídicos úteis e; v) conclusão. Observar essas características, é uma maneira de traçar novas estratégias para combater a crise climática no Brasil e abrir o diálogo sobre o tema, engajando partes importantes da sociedade civil para uma luta cada vez mais urgente.
In 2020, there was a turning point in the Brazilian climate litigation scenario. A movement that had been gaining strength in inter-national courts and other countries remained small and diluted in Brazil, a large emitter of greenhouse gases (GHG). However, the emergence of new Brazilian cases that directly address climate change shows a new possibility of tackling the climate crisis and a possible increase in enga-gement with the issue. This paper proposes, through a literature review, to analyze the Brazilian position in the global phenomenon of climate litigation and its domestic context. To this end, the text is divided into: i) a general introduction on climate litigation and the urgency of action; ii) the domestic context and relevant jurisprudence; iii) characteristics within the global context; iv) useful legal instruments and; v) conclusion. Observing these characteristics, is a way to outline new strategies to fight the climate crisis in Brazil and open the dialogue on the subject, engaging important parts of civil society for an increasingly urgent fight.
