Lineamentos de uma Teoria Agnóstica da Medida Socioeducativa

Resumo Português:

O presente artigo defende, no âmbito do direito penal juvenil, a adoção de uma teoria agnóstica da medida socioeducativa. Para tanto, analisa-se a evolução histórica do tratamento jurídico à infância e juventude no Brasil; em seguida, apresenta-se brevemente a medida socioeducativa em nosso ordenamento jurídico, apontando os seus fundamentos explícitos (manifestos); na sequência, tais fundamentos são problematizados a partir da criminologia crítica. Passando à dogmática, são trabalhadas as justificações doutrinárias mais comuns da medida socioeducativa – pedagogia e retribuição –, para, em um segundo momento, realizar-se a devida crítica, concluindo-se no sentido de uma teoria agnóstica da medida socioeducativa, apresentando-se as suas principais características.

This paper stands for the adoption of an agnostic theory of correctional measures in juvenile penal law. Therefore, the paper investigates the history of criminal treatment to youth in Brazil. On the sequence, it studies correctional measures to youth in Brazilian law, presenting its application requirements, explicit legal basis and branch of law to which this form of sanction belongs, in order to follow break up on the official discourse by critical criminology’s theoretical tools. Finally, the paper face up the most current dogmatic justifications – pedagogy and retribution –, to critically conclude towards an agnostic theory of correctional measures, presenting its fundamental aspects.
