No início do século seguinte àquele em que a ciência chegou perto da clonagem humana, muito se fala sobre o desenvolvimento científico. A busca do homem por condições que lhe permitam, inclusive, lutar até contra a sua finitude está cada vez mais profunda. É nesse contexto que o Direito é chamado a atuar a fim de regulamentar as mais complexas situações fáticas. É a fim de que não se percam a ética e as diretrizes axiológicas dos atores envolvidos nesse cenário, que a Bioética e o Biodireito se apresentam. E, amparadas pelo valor que fundamenta a República, e dá alicerce ao Estado Democrático de Direito, a dignidade da pessoa humana, é que se desenvolvem as necessárias diretrizes jurídico-normativas a sustentar todo o sistema.
Resumo Inglês:
At the beginning of the century following that in which science came close to human cloning, much is said about scientific development. The search of man for conditions that even allow him to fight against his finitude is ever deeper. It is in this context that the law is called to act in order to regulate the most complex factual situations. It is in order that the ethics and the axiological guidelines of the actors involved in this scenario, which Bioethics and the Bio will not be lost. And, supported by the value that underlies the Republic, and underpins the Democratic State of Law, the dignity of the human person, is that the necessary legal-normative guidelines are developed to support the whole system.
