A dicotomia sujeito-objeto ensejou a preponderância do saber científico e do saber técnico sobre outros saberes, colocando o mundo e o próprio humano na condição de seres manipuláveis. O humano, assim tornado coisa, teve seu valor reduzido à sua capacidade técnica, sendo classificado e tendo seu sucesso determinado pela maior ou menor produtividade, ou seja, encontra-se submetido a uma valoração segundo parâmetros mercadológicos, que reduz tudo a mero recurso, a objetos de troca amoldados à indiferença do mercado, erigindo-se uma sociedade indiferente, reificada e regida pelo automatismo imposto pela racionalidade instrumental, que a torna incapaz de pensar seus rumos, tampouco a justiça de seus fins, na qual o humano é mera peça da engrenagem do onipresente e onipotente Mercado; uma sociedade massificada, amorfa, indistinta e indiferente. Insculpido nesse quadro, e moldado ao seu formato, é que se encontram o Direito hodierno e a Justiça, que de sua práxis advem: um degradado modelo, que se reduz a uma linha de produção de demandas e soluções assentadas na padronização, sob o molde fordista, voltada à satisfação dos anseios de um sujeito-massa, amorfo e sem face, sem espaço para a singularidade, para as nuances da concretude de cada caso; perde-se a individuação pela preponderância das metas e estatísticas quantitativas de avalição mercadológicas, em detrimento da efetiva valoração do conteúdo ético das decisões. Eis aí a mercantilização da Justiça pela mercantilização do instrumento de sua realização, que é o Direito.

The subject-object dichotomy gave rise to the preponderance of scientific knowledge, of technical knowledge over other kind of knowledges, putting the world and the human being in the condition of manipulable beings. The human being, objectified thus, had its value reduced to its technical capacity, being classified and having its success determined by its greater or lesser productivity, that is, it is submitted to a valuation according to market parameters, which reduces everything to mere resources, to objects of exchange shaped by the indifference of the market, establishing, this way, an indifferent society, reified and governed by the automatism imposed by instrumental rationality that makes it incapable of deciding its course, nor the justice of its ends, where the human being is merely a part of the omnipresent and omnipotent market gear; a mass society, amorphous, indistinct and indifferent. Inscribed in this framework, and molded to its format, it is today’s Law and Justice that come from its praxis: a degraded model that is reduced to a production line of demands and solutions based on standardization, under the Fordist model, aimed at fulfilling the desires of a subject-mass, amorphous and faceless, with no room for singularity, nor to the nuances of the concreteness of each case; individuation is lost due to the preponderance of the goals and quantitative statistics of market evaluation, to the detriment of the effective valuation of the ethical content of the decisions. This is the commodification of Justice by the commodification of the instrument of its concretion, which is law.
