O presente artigo pretende realizar uma breve reflexão sobre a ADPF n. 153 a partir da relação entre o juiz e o historiador. O texto procura defender que a argumentação utilizada pelo STF, ao judicializar o passado, desconsiderou o verdadeiro sentido das lutas sociais em prol da anistia política de 1979, legitimou o caráter autoritário do regime militar e desqualificou o caráter de ruptura da Constituição de 1988. Possui, portanto, efeitos nefastos sobre a democracia constitucional brasileira.
Resumo Inglês:
The objective of the paper is reflecting on the STF’s decision in the ADPF n. 153 from the relationship between the judge and the historian. The text argues that the reasoning used by the Supreme Court, judging the past, disregarded the true sense of the social struggles in favor of the 1979 political amnesty, legitimized the authoritarian character of the military regime and underestimated the sense of rupture of the 1988’s Constitution. Therefore, it has adverse effects on brazilian constitutional democracy.
