One of the most controversial topics of constitutional philosophy is the debate on the role of constitutional social adjudication. Does the contemporary process called legalization of rights have democratic legitimacy? To have an answer this article research the philosophic grounds about the theme, before return to the position used by courts and the one according with the theoretical Marxist, following the way presented here.
