Lança-se sobre o período imperial brasileiro com a finalidade de analisar a realidade que então se fixou a partir da Carta Constitucional de 1824. Busca-se, então, compreender as contradições que foram se estabelecendo desde a formação de um liberalismo conservador até a manutenção do regime escravista, que será o motor do desenvolvimento econômico e, entretanto, a principal forma de acirramento das desigualdades do país. Analisa-se, de igual maneira, as inovações legislativas que surgiram nesse contexto, também, muitas vezes, acirrando as contradições e ambiguidades. Constata-se, por conseguinte, que apesar de tamanha evolução, seja quanto ao arcabouço jurídico formado, seja em relação à própria situação de independência, podem-se perceber que as contradições foram se enraizando e instituindo cada vez mais a desigualdade.
Resumo Inglês:
This paper aims to study the brazilian imperial period with the purpose of analyzing the reality built with the 1824 Constitution. Therefore, it’s necessary to understand the contradictions that have been established with the conservative liberalism and the maintenance of the slave regime. These were responsible for the institution for one of the greatest contradictions of this period. Following with a critical evolution of the brazilian slavery legislation to demonstrate the legislative reform that took place on gradual and progressive standards. Consequently, in spite of a great evolution, it can be seen that the contradictions have taken root and have increasingly established the inequality.
