O artigo apresenta breve panorama histórico do controle de constitucionalidade, abordado sob a perspectiva da ausência do stare decisis na experiência constitucional brasileira. Aponta as inovações mais marcantes trazidas pelo legislador, do advento da República até os dias de hoje, buscando referência às influências do direito comparado. Sinaliza as novas tendências do controle de constitucionalidade, com uma dinâmica que passa a priorizar, por meio da implantação de diversos mecanismos, o controle abstrato, e vem a apresentar novas feições com a promulgação do novo Código de Processo Civil.

The article presents a brief historical overview of judicial review, approached from the perspective of the absence of stare decisis in the Brazilian constitutional experience. Points out the most significant innovations introduced by the legislature, from the advent of the Republic to the present day, seeking reference to the influences of Comparative Law. Signals new trends of judicial review, with a dynamic passing prioritize, through the implementation of various mechanisms, the abstract control, and come to present new features with the advent of the new Civil Procedure Code.
