A questão do nome de pessoas e os atributos e as responsabilidades a ele atribuídas vem sendo posta sob crítica pelo movimento LGBTQIAPN+. Em 2016, o governo federal promulgou o Decreto n. 8.727/2016, que dispõe sobre o uso de designação pela qual a pessoa transgênero se identifica e é socialmente reconhecida (nome social) nos registros dos sistemas de informação, cadastros, prontuários e congêneres dos órgãos e das entidades da administração pública federal direta, autárquica e fundacional. Este trabalho se baseia na discussão sobre como esse reconhecimento é um recurso expressivo e político para um sujeito social. A pesquisa tem como objetivo refletir sobre os elementos e os efeitos sociais, culturais, jurídicos e políticos do uso do nome social em sistemas de informação na consolidação dos direitos fundamentais de dignidade humana e de saúde, como o Sistema Único de Saúde e o Sistema Único de Assistência Social. Trata-se de estudo exploratório-descritivo, de abordagem qualitativa, com análise documental e bibliográfica. A partir da análise de dispositivos normativos, foi realizada reflexão acerca dos procedimentos e da repercussão do uso do nome social nas discussões na área da Ciência da Informação, especificamente à luz da teoria de Regime da Informação. Foram identificados atores sociais inseridos no regime e os dispositivos que o regem, além dos artefatos de informação (cartão nacional de saúde e prontuário eletrônico) e das ações de informação com vista à promoção do combate ao preconceito contra a população LGBTQIAPN+ no acesso a processos de retificação do nome e a benefícios sociais e programas de saúde.
The issue of people’s names and the attributes and responsibilities attributed to them has been criticized by the LGBTQIAPN+ movement. In 2016, the federal government enacted Decree n. 8.727/2016, which provides for the use of the designation by which transgender people identify themselves and are socially recognized (social name) in the records of information systems, registries, medical records and similar of the bodies and entities of the direct, autarchic and foundational federal public administration. This work is based on the discussion of how this recognition is an expressive and political resource for a social subject. The research aims to reflect on the social, cultural, legal and political elements and effects of the use of the social name in information systems in the consolidation of fundamental rights to human dignity and health, such as the Unified Health System and the Unified Social Assistance System. This is an exploratory-descriptive study, with a qualitative approach, with documentary and bibliographic analysis. Based on the analysis of normative devices, reflections were made on the procedures and the impact of the use of the social name in discussions in Information Science, specifically in light of the Information Regime theory. Social actors inserted in the regime and the devices that govern it were identified, in addition to information artifacts (national health card and electronic medical record) and information actions aimed at promoting the fight against prejudice against the LGBTQIAPN+ population in access to name rectification processes and social benefits and health programs.
